Privacy Policy “Polly” App

I place the highest value on protecting your privacy and your personal data. The following statement informs you about how I ensure this protection within the framework of my mobile application (hereinafter “Polly”) and what type of data is not processed for what purpose.

1. Scope of Application and Data Controller

This privacy policy applies to the use of my app.

The data controller within the meaning of the General Data Protection Regulation (GDPR) and other data protection regulations is:

Jonas Gaudian, play [at]gaudian [dot] eu

2. Principles of Data Processing in this App

The operation of this app strictly follows the principle of data minimization according to Art. 5 Para. 1 lit. c GDPR.

I hereby expressly confirm that no personal data (according to Art. 4 No. 1 GDPR) or other usage-related data is collected, processed, stored or evaluated by me as the controller through the use of this app.

This includes in particular:

  • No collection of master data: No names, addresses, email addresses or contact details are requested or stored.
  • No collection of device identifiers: I do not access device identifiers (e.g. UDID, IMEI, advertising ID), the IP address or other technical identifiers of your device.
  • No collection of location data: The app does not determine or process your location at any time.
  • No analysis of user behavior: There is no tracking, profiling or any other form of analysis of your interactions with the app.

Since data collection does not take place, there is consequently also no storage, no disclosure to third parties and no transmission to third countries.

3. Use of External AI Services (LLM APIs)

This app offers you the possibility to connect to the application programming interfaces (APIs) of external providers of so-called large language models (LLMs) (e.g. OpenAI for ChatGPT, Mistral from Mistral AI, or a model hosted by yourself).

Your Responsibility and Control

The selection of the service as well as the input of the necessary access data (e.g. an API key) is done exclusively by you as the user.

Data Flow and Storage

  • What is transmitted? When you send a request to an LLM service, your text inputs (prompts) are transmitted directly to the provider you have selected via the app.
  • What I do store? As a developer, I do not store or log your API keys, your inputs (prompts) or the responses received from the LLM service at any time. Your API key is stored exclusively locally and securely on your own device and is never transmitted to me or uninvolved third parties.

Disclaimer and External Data Protection

I have no influence on the data processing practices of the LLM providers you choose. Once your data leaves the app and is sent to the external service, it is subject to the privacy policies and terms of use of the respective provider. It is your responsibility to familiarize yourself with these provisions before using the service. I accept no responsibility or liability for the handling of your data by these third parties.

4. Waiver of Third-Party Services

I confirm that I have not actively integrated any additional Software Development Kits (SDKs) or Application Programming Interfaces (APIs) from third parties for purposes such as advertising, user analysis or social media integration into this app. The app works without the transmission of data to such services.

Automatic Data Collection by the Android Platform

As a developer for the Android operating system, however, I point out that Google, as the provider of the platform and the Google Play Store, may collect certain data on its own responsibility. I have no influence on these processes.

This mainly concerns:

  • Distribution via Google Play Store: When downloading the app via the Play Store, Google processes data linked to your Google account (e.g. username, time of download).
  • Android Vitals (diagnostic data): To ensure the stability of apps offered on the platform, Google may automatically collect anonymized data on crashes, errors (ANRs) and basic performance. These aggregated reports help me as a developer to improve the technical quality of the app without being able to identify individual users.

The responsibility for this data processing lies exclusively with Google. You can find more information directly in Google’s privacy policy.

5. Data Processing by Distribution Platforms (App Stores)

I point out that the operators of the distribution platforms (e.g. Google Play Store) through which you obtain this app process data independently. This may include information about your user account, payment data and device identifiers. As the provider of the app, I have no influence on these data processing processes; the responsibility for this lies exclusively with the respective platform operator. Please inform yourself in the privacy policies of the corresponding provider.

6. Your Rights as a Data Subject

The GDPR grants you comprehensive rights as a data subject (including information, correction, deletion). However, since I do not store any personal data from you, I also have no control over it. Information about or deletion of non-existent data is not possible. If you still have data protection questions, you can contact the contact address mentioned under point 1 at any time.

7. Timeliness and Amendment of this Privacy Policy

This privacy policy will be adapted as needed, for example due to a changed legal situation or functional changes to the app. The version current at the time of use applies.
